General Information
Please read this TOS to avoid any miscommunications that may arise.**
**If you have questions, feel free to send me a message and I will respond as soon as I can. Thank you!

Payment

  • I will start a commission only after receiving at least half of the payment upfront.

  • All payments are in USD and made via PayPal.

  • I will expect to receive the rest of the payment upon project completion (if the initial payment was not made in full).

  • Payments are non-refundable once I start on a project.

  • The maximum amount of time I am willing to wait for completed payment after finishing a personal commission is 2 weeks (10 business days).

Commercial Use

  • Commercial rights: If the Client intends to use the Work for commercial purposes, the Artist will receive royalties of 20% of gross profits directly attributable to the Work.

  • Reporting: The Client agrees to provide quarterly sales reports and remit royalty payments within 30 days of each quarter's end.

Work In Progress (WIP)

  • I will always provide WIPs in our early stages of discussion. This is to show you my vision and for you to request changes if any.

  • I usually send additional WIPs as I work on the commission to keep you updated with progress. Feel free to message me if I have not.

  • Additional revisions: Beyond the two (2) included revisions, additional revisions will be charged at $20 per revision, to be agreed upon before commencement up to a maximum of five times.

  • Expenses: Any out-of-pocket expenses related to the creation of the Work, such as materials, framing, or shipping, shall be reimbursed by the Client upon presentation of receipts.

Deadlines and waiting times

  • For personal commissions, please expect a slightly longer waiting time as I might also be working on commercial projects.

  • For commercial projects, I will appreciate a level of correspondence to keep me up to date on the agreed deadline(s). I will negotiate terms if the deadline is unfair.

  • For all commissions, please expect a wait time anywhere from a week to 3 months. I usually have a waiting list and I would like to request your patience.

  • Portrait commissions have the shortest waiting time and are usually finished anywhere within a week.

Refunds

  • If your waiting time for a commission below Tier 3 would be longer than half a year, I will offer a full refund.

  • For all personal commissions, if you really need a refund because something troubling has come up and you desperately need the money, DM me and we'll discuss it.

Dos and don'ts for me

  • I always have the right to decline your commission, without giving my reasons.

  • I will not draw anything NSFW.

  • I will also not draw anything that has to do with extreme political subjects, hateful messages, copying another artist’s work, etc.

  • I will not repurpose other people's work in my projects unless it is a royalty-free asset or my own.

  • I'm allowed to use the finished artwork in my portfolio and upload it to my own page. If there is an non-disclosure agreement for a project, I will respect it until the NDA expires.

Dos and don'ts for you

  • If you're not sure about an idea or design, feel free to ask.

  • Communication is key; please provide me with details and examples in your messages. I will often want clarification so that I know my design for your project is correct.

  • For character related commissions, if your character has a backstory, feel free to tell me all about them! It helps me visualise the scene.

  • When a commission is finished, you will receive a full HD version of it via Google Drive.

  • For all non-commercial work, I will not remove the watermark and I ask you kindly not to remove it either.

  • If you post the commission somewhere, please link back to my Instagram profile or to the page where I uploaded the commission.

Violations and penalties

  • Removing my watermark from a commissioned piece without my agreement violates my Terms of Service and you will be banned from my services.

  • Reselling, repurposing, or reproducing my work in any shape or form without my permission or commercial agreement is strictly prohibited, whether or not you have commissioned the piece in question.

  • Prohibited examples include selling physical merch of my art, minting my work as an NFT, using my work in AI generators, and any other method of theft, reproduction or resale with the intent of exploit. In most cases, a DMCA takedown notice will be issued for fraudulent acts.

  • Mutual respect between artist and client is very important to me. If you disappear without paying for the commission, I will retain the full rights to it and will be allowed to auction it off to somebody else.

  • My online identity is mirrorglass_ on the listed sites of my main webpage and MirrorGlassArts on deviantArt. Any person claiming to be me outside of those platforms is an impersonation. Please be careful when requesting my services.

Termination

  • This Contract may be terminated by either Party upon written notice if the other Party breaches any of its obligations under this Contract and fails to remedy such breach within 7 days after receiving notice.

  • Force Majeure: Neither Party shall be liable for any failure to perform its obligations under this Contract if prevented from doing so by a force majeure event (such as natural disaster, war, pandemic, or other unforeseeable event beyond the control of the Party).
